Your Business Responsibilities

Environment, Health and Safety (EHS) compliance is a critical component to any successful business and it is important that all aspects of EHS risk are adequately managed within a company. If a company does not fulfil their duties or obligations and breaches or is non-compliant with an environmental, health or safety law then such a violation could result in the increased risk of injury, illness or death of an employee or third party, a major environmental incident and/or severe economic penalties, suspension of operations or imprisonment of staff and/or senior management personnel.

SLP Environmental can assist your business with respect to your regulatory compliance with in-country local, regional and national environmental health and safety regulations and legislation and offers environmental, health and safety compliance auditing and risk management consulting and advisory services throughout south east Asia.

Preparation of bespoke EHS Legal Registers

If your business is operating in an industry or implements a manufacturing process for which compliance with a wide range of rules and regulations is necessary, it is important that your company has a management system in place to ensure you can manage and meet your EHS regulatory obligations.

SLP Environmental can assist companies by identifying the EHS regulations which are applicable to their business operations (and incorporate other factors such as the location, size, and nature of the operation) and develop an EHS legal register for their clients operations which in turn becomes a comprehensive, practical tool that improves the efficiency and risk management of a business and thereby reduces costly mistakes.

Put simply, an EHS Legal Register (LR) is a bespoke inventory of all the environmental, health and safety laws, regulations and notifications etc that apply to an existing or planned operation for the location (country or province) where the operation is or will be undertaken. An EHS LR is organised by major themes (e.g. Technical Safety) which are then further divided into sub themes (e.g. Machine Guarding, Cranes etc). The major themes included in a legal register are:

EnvironmentalHealth and Safety
General EnvironmentGeneral Safety
Hazardous SubstancesWorking Conditions
WasteOccupational Health and Safety
WastewaterTechnical Safety
Soil and GroundwaterHazardous Materials
Air and NoiseEmergency Preparedness
Energy

The EHS legal register becomes a checklist of legal requirements which a company can manage, implement and oversea to ensure their business remains compliant with EHS regulations. If properly maintained and kept up to date, the register thus becomes a vital source of reference that will quickly and easily answer any EHS queries that arise.

A well-maintained and organised legal register will also help an organisation to meet the compliance requirements within current environmental management systems standards, including ISO 14001 and ISO 50001. With regard to health and safety, ISO 45001 requires organisations to establish, implement and maintain a procedure for identifying and accessing the legal and other requirements that are applicable to it. Keeping this information up-to-date, an organisation must ensure that these applicable legal requirements are taken into account in establishing, implementing and maintaining its occupational health and safety management system.

Access to a basic register which categorises the key legislation by themes — health and safety management, hazardous substances, waste, pollution, technical safety, emergency preparedness and includes access to readable summaries of each item of legislation will save considerable amounts of time in-house. If requested by our clients, the register can also ensure that newly published items of legislation are not overlooked and that regulations with implications for more than one subject area (possibly for both environment and health and safety) are flagged up accordingly.

Health, safety and environment management standards including ISO 45001 and ISO 14001 do not specifically require organisations to maintain legal registers but doing so is one of the most efficient and cost-effective ways of meeting their demands that participating organisations are able to identify, access and keep up-to-date with the legal and other requirements that are applicable to their sector. A register can also be a valuable tool when it comes to preparing for a compliance audit, to organising training courses and to setting out an emergency plan.

Environmental, Health and Safety Compliance Audits

Environmental, Health & Safety (EHS) Compliance Assessment is a critical part of the risk and liability management process associated with assessing, maintaining and improving EHS performance at a particular facility or operation. Clients typically instruct EHS Compliance Audits to assess whether operations and activities at a facility or project site are following host country legal requirements and corporate HSE performance standards, and where non-compliances are revealed our team of specialists identify the root causes and recommend the appropriate corrective actions.

A typical onsite audit comprises of a facility walk through, a review of the requested EHS documentation, interviews with key personnel, further targeted inspections of selected activities and a close out and wrap-up briefing to facility and corporate management detailing the main audit findings. Our detailed reports identify the EHS non-compliances and root causes, which are ranked by significance based on risk assessment techniques to derive an overall Risk Factor for each finding. For each finding our reports include recommendations with respect to the corrective actions, associated budgetary allocations and timelines for implementation based on the assigned risk factor.

Our team comprises of English, Thai and Burmese speaking EHS specialists but we can also assist businesses with Japanese, Vietnamese and Bahasa Indonesian and Bahasa Malaysian speaking senior management and local management teams as well.
