Thailand: Code Of Practice (CoP) And Environmental And Safety Assessment (ESA) Services

SLP Environmental is pleased to announce that we can offer a full Code of Practice (CoP) and Environmental and Safety Assessment (ESA) service for clients developing or funding projects in the renewables sector within the Kingdom of Thailand.

Most solar and wind power renewables projects in Thailand now require the preparation of a CoP report for submission to the Energy Regulatory Commission (ERC) as part of the application for an Electricity Generating License and an ESA report for submission to the Ministry of Industry as part of the application for an Operating Permit (Ror Ngor 4). The CoP report is required under the ‘Notification of Energy Regulatory Commission (Code of Practice)’ dated September 2557 and the ESA report under the ‘Notification of Ministry of Industry Re: Preparation of report on the study of prevention and mitigation measures on the impact to environmental quality and safety’ dated September B.E.2552. A brief overview of the regulatory requirements and topics covered in both of these two studies is presented in the table below.

Main Study ObjectivesFollow the CoP which is prescribed by ERC for each project type. Ensure community and stakeholder engagement at the project outset. Incorporate stakeholder feedback into project design & implementation. Identify adverse impacts to the natural environmental and natural resources associated with project activities during the construction, operation and decommissioning phases. Formulate and implement an effective environmental management & monitoring plan to mitigate identified impacts. Enhance the positive impacts of project. – Establish environmental baseline conditions. – Identify adverse impacts to the natural environmental and natural resources associated with project activities during operational phase. – Formulate and implement an effective environmental management & monitoring plan to mitigate identified environmental impacts. – Identify the health and safety hazards associated with project activities during operational phase. – Formulate hazard management measures to prevent, control or mitigate H&S hazards. – Present the Fire Prevention and Suppression Plan and the Emergency Preparedness and Response Plan for the project. – Detail the H&S management structure and system that will be implemented at the facility to ensure and monitor compliance with HSE regulations and internals practices and procedures.

The CoP report is similar in structure and content to an Initial Environmental Examination (IEE) report which are often requested by project lenders and equity investors as part of their internal corporate social responsibility due diligence requirements and SLP Environmental can also prepare the IEE report in tandem with the preparation of the CoP and ESA reports for the Thai regulators.

The ESA study is similar in structure and content to the COP study but includes an added requirement to consider the health and safety aspects associated with the project and propose risk control and reduction measures where health and safety hazards are identified.
